Terms of Use

Welcome to Glow Up by Raincode LLC. These Terms of Use ("Terms") govern your access to and use of the Glow Up mobile application ("App") and related services provided by Glow Up ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility and Account

To use the App, you must:

• Be at least 13 years old (or the minimum age in your jurisdiction)
• If under 18, have the permission of a parent or legal guardian
• Provide accurate account information
• Maintain the confidentiality of your login credentials

You are responsible for all activity on your account. We reserve the right to suspend or delete accounts for violations of these Terms.

2. User Content and Image Uploads

You may upload photos, create looks, and save makeup styles using the App. By doing so, you represent that:

• You own the rights to any images you upload or have permission to use them
• You grant us a non-exclusive, revocable license to process and display your images to provide services
• You will not upload any content that is offensive, abusive, unlawful, or infringes on third-party rights

We reserve the right (but not the obligation) to remove any content that violates these rules or applicable laws.

3. License and Intellectual Property

Glow Up and its content (excluding user-generated content) are protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

You agree not to:

• Modify, reverse engineer, or resell the App
• Use the App to develop a competing service
• Copy or extract source code or algorithms
• Use automated tools or bots to access the App

All rights not expressly granted are reserved by Glow Up.

4. Payments and Subscriptions

Some features of the App may require a paid subscription or in-app purchase. If you choose to subscribe:

• Your payment will be charged to your Apple ID account
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• You can manage or cancel your subscription in your Apple account settings
• We reserve the right to change pricing with reasonable notice

All purchases are final and non-refundable, except as required by law or Apple's policies.

5. Prohibited Conduct

You agree not to:

• Use the App in any way that violates laws or regulations
• Upload content that includes nudity, violence, hate speech, or harassment
• Impersonate others or misrepresent your identity
• Use the App to harass, stalk, or harm others
• Attempt to interfere with our servers or systems

Violation of these rules may result in termination of your account and legal action.

6. Disclaimers

The App is provided "as is" and "as available." We make no warranties regarding:

• The accuracy or realism of AI-generated makeup results
• Continuous, error-free, or secure access
• The effectiveness or suitability of suggested styles or looks

Use of the App is at your own risk. We are not liable for any harm resulting from your reliance on the App's features or suggestions.

7. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, or consequential damages
• Our total liability for any claim related to the App will not exceed the amount you paid for the service (if any) in the past 12 months
• This limitation applies even if we were advised of the possibility of such damages

Some jurisdictions may not allow these limitations, so they may not apply to you.

8. Termination

We may suspend or terminate your access to the App at any time, with or without notice, for violating these Terms or for any reason at our sole discretion.

You may delete your account at any time in the app settings.

9. Updates and Changes

We may update these Terms from time to time. If we make material changes, we'll notify you via app alert or email. Your continued use of the App after changes become effective means you accept the new Terms.

10. Governing Law and Disputes

These Terms are governed by the laws of The United States of America, excluding its conflict of law principles.

You agree to resolve any dispute through binding arbitration or small claims court, unless prohibited by applicable law. You waive your right to participate in class actions.
